What if we can't agree?
Many parents are able to reach an agreement through discussion or mediation.
If agreement isn't possible, an application can be made to the Family Court for a Child Arrangements Order. The court's priority will always be the welfare of the child.
When making decisions, the court considers factors including:
- The child's wishes and feelings (where appropriate)
- Their physical, emotional and educational needs
- The likely impact of any proposed changes
- Any risk of harm
- Each parent's ability to meet the child's needs
